These Terms of Service ("Terms") govern your access to and use of CashKiddo's website, mobile application, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

For Parents/Guardians: If you're creating an account for a child under 18, you represent that you are the parent or legal guardian and have authority to agree to these Terms on behalf of the child.

2. Eligibility

2.1 Account Creation

• You must be at least 18 years old to create a CashKiddo account
• Children cannot create accounts independently
• Parents/guardians must verify their identity and provide consent
• One parent account can manage up to 3 child profiles (Premium tier)

2.2 Geographic Restrictions

CashKiddo is currently available in India and select international markets. Some features may vary by location.

3. Description of Service

CashKiddo provides:

• Educational Content: Financial literacy stories and lessons
• AI Companion: Voice-based conversations with Casey the Kangaroo
• Investment Simulator: Risk-free stock market practice with virtual money
• Parent Dashboard: Progress tracking and insights

4. Account Responsibilities

4.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your child uses the service appropriately

4.2 Accurate Information

You agree to provide accurate, current, and complete information during registration and keep it updated.

5. Acceptable Use Policy

5.1 You May

• Use CashKiddo for personal, non-commercial educational purposes
• Allow your children to interact with Casey for learning
• Practice virtual stock trading for educational purposes
• Access and download your child's learning data

5.2 You May NOT

• Share your account credentials with others
• Use the Service for any illegal or unauthorized purpose
• Attempt to hack, reverse engineer, or exploit the Service
• Use automated tools (bots, scrapers) to access the Service
• Resell or redistribute CashKiddo content
• Impersonate others or provide false information
• Abuse, harass, or harm other users
• Upload malicious code or viruses
• Attempt to manipulate or abuse the AI voice system (e.g., trying to make Casey respond inappropriately)
• Use voice recordings for any purpose other than personal educational use
• Share or distribute voice recordings without consent

6. Subscription and Payment

6.1 Free Tier

CashKiddo offers a free tier with limited features. We reserve the right to modify or discontinue the free tier at any time.

6.2 Premium Subscription (When Available)

• Billing: Monthly or annual subscriptions (prices displayed at checkout)
• Auto-Renewal: Subscriptions automatically renew unless canceled
• Payment Methods: Credit card, debit card, UPI, or other accepted methods
• Price Changes: We'll notify you 30 days before any price increase

6.3 Cancellation and Refunds

• You can cancel anytime from your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months (unless required by law)
• 7-Day Money-Back Guarantee: Full refund if you cancel within 7 days of first payment

6.4 Failed Payments

If payment fails, we'll notify you and attempt to charge again. Continued failure may result in account suspension.

6.5 Voice Data After Cancellation

If you cancel your subscription or delete your account:

• Free tier users: Voice recordings stored according to free tier limitations (see Privacy Policy)
• Canceled premium: Full voice history retained for 30 days after cancellation, then follows free tier limitations
• Account deletion: All voice data, transcripts, and personal information permanently deleted within 30 days
• Data export: You can export all voice recordings and transcripts before deletion

7. Intellectual Property

7.1 CashKiddo's Rights

All content, features, and functionality of CashKiddo are owned by us and protected by copyright, trademark, and other laws. This includes:

• Casey the Kangaroo character and voice
• Educational stories and lessons
• Software, algorithms, and AI models
• Graphics, logos, and design elements

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use CashKiddo for personal, non-commercial purposes.

7.3 User Content

You retain ownership of any content you create (e.g., portfolio notes). By using CashKiddo, you grant us a license to use this content to provide and improve our Service.

8. Voice Data and Recordings

8.1 Voice Recording Consent

By using CashKiddo's voice features, you (the parent/guardian) explicitly consent to:

• Recording and storing your child's voice interactions with Casey
• Processing voice data through our AI providers (OpenAI, Anthropic, ElevenLabs)
• Storing voice recordings and transcripts for the duration of your account
• Using anonymized voice data to improve our AI models and educational content

8.2 Parent Control Over Voice Data

You have full control over voice recordings:

• Review all recordings via the parent dashboard
• Delete individual recordings at any time
• Export all voice data in machine-readable format
• Delete all voice data by closing your account

8.3 Voice Data Usage

We use voice recordings ONLY for:

• Personalizing your child's learning experience
• Improving AI conversation quality and accuracy
• Tracking educational progress and achievements
• Resolving disputes or addressing safety concerns

We will NEVER:

• Sell voice recordings to third parties
• Use voice data for advertising or marketing
• Share recordings without your consent (except as required by law)
• Allow unauthorized access to your child's voice data

8.4 Child Safety Monitoring

For child protection purposes, if we detect concerning content in voice recordings (such as mentions of abuse, self-harm, dangerous activities, or illegal content), we reserve the right to:

• Review the recording with appropriate safeguards
• Contact the parent/guardian immediately
• Report to appropriate authorities if required by law
• Suspend or terminate the account if necessary for safety

This monitoring is for safety only and does not imply any responsibility to monitor all content.

9. Educational Disclaimers

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CashKiddo is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for third-party services (AI providers, payment processors)
• We don't guarantee uninterrupted or error-free service

10. Indemnification

You agree to indemnify and hold harmless CashKiddo, its officers, employees, and partners from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Service
• Your violation of any third-party rights

11. Privacy and Data Protection

Your use of CashKiddo is also governed by our Privacy Policy, which details how we collect, store, and protect voice recordings and other personal data. By agreeing to these Terms, you also agree to our voice data storage practices as described in the Privacy Policy.

12. Termination

12.1 Your Right to Terminate

You may delete your account at any time from account settings. All data will be permanently deleted within 30 days.

12.2 Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users
• Fail to pay subscription fees

We'll provide notice when possible, but may terminate immediately for serious violations.

13. Modifications to Service and Terms

We reserve the right to:

• Modify or discontinue features
• Add new features or content
• Change pricing (with 30 days notice)
• Upgrade technology and infrastructure
